5. How and why I use personal information
UK data-protection law requires me to have a lawful basis for using personal information.
Depending on the circumstances, I rely on one or more of the following lawful bases.
Taking steps before entering into a contract
I use information you provide to:
Respond to enquiries.
Check availability.

Performing a contract
I use personal information where it is necessary to:
Confirm and manage a booking.

Provide customer support.
Manage payments, cancellations or refunds.

Create previews, proofs, showreels, galleries and downloads.
Manage copyright, licences, permissions and usage restrictions.
Deal with reorders, archive requests or future licensing.
Establish, exercise or defend legal claims.
Maintain a record of the work I have produced.
Depending on the circumstances, this processing may be based on performance of a contract, legitimate interests, consent or compliance with a legal obligation.
The client or organisation commissioning the work may also be a separate data controller for how it uses, publishes or distributes the resulting photographs, video or audio. Questions about a client’s use of that content should normally be directed to the relevant client or organisation.
Portfolio and promotional use
I may display selected photographs or video in my:
Website portfolio.
Blog.
Social-media channels.
Showreels.
Printed portfolio.
Presentations.
Award entries.
Marketing and promotional materials.
I will only do this where the use has been agreed, is reasonably expected and is otherwise lawful.

Confidentiality restrictions.
The context in which the content was created.
Safeguarding considerations.
Reasonable objections raised by identifiable individuals.
I will not normally use confidential, private or sensitive project material for promotional purposes without specific agreement.
I will only use identifiable images of children for my own promotional purposes where there is an appropriate lawful basis and I have considered relevant permissions, the circumstances of the photography and safeguarding requirements.
Legitimate interests
I may process personal information where it is reasonably necessary for the legitimate operation of my business, provided that these interests are not overridden by your rights.
These interests include:
Managing client and customer relationships.
Keeping appropriate records of enquiries and agreements.
Improving my website, services and customer experience.
Understanding how people find and use the website.
Protecting the website against fraud, misuse and security threats.
Managing and promoting my business.
Responding to business contacts.
Maintaining appropriate records of copyright, licences, permissions and usage restrictions.
Retaining selected project files for reasonable archive, portfolio, reorder or licensing purposes.

Using non-essential cookies and similar tracking technologies.
Certain advertising, remarketing or profiling activities.
Particular uses of photographs, video or audio where consent is the most appropriate lawful basis.
You may withdraw your consent at any time.
Withdrawing consent does not make any use of your information before the withdrawal unlawful. It may also not require me to delete information that I need to retain under another lawful basis.
6. Information you need to provide
You are not generally required by law to provide personal information to me.
However, certain information is necessary if you want me to:
Respond properly to an enquiry.
Prepare a quotation.

You have joined a relevant waiting list.

You can unsubscribe at any time by:
Using the unsubscribe link in a marketing email.
Replying to the message.
Contacting ross@rossjukesphoto.co.uk.
Unsubscribing from marketing will not prevent me from sending essential messages about an enquiry, booking, order or contract.
I may retain a limited suppression record after you unsubscribe so that I can respect your request and avoid adding you back to a mailing list accidentally.
I do not sell mailing lists or personal information to other businesses.
8. Cookies and similar technologies

Clients and project partners
Photographs, video, audio and related information may be supplied to the client, agency, organisation or production partner that commissioned the project.
That organisation may be independently responsible for how it subsequently publishes, distributes or uses the content.
Marketing, analytics and advertising providers
Subject to your choices and applicable law, information may be processed by providers such as:
Google.
Meta.
Email-marketing services.
Affiliate and advertising platforms.
Website analytics providers.
Some of these organisations may act as independent data controllers for aspects of their services. Their own privacy policies will explain how they use personal information.

Information may be shared where necessary with:
Accountants.
Bookkeepers.
Insurers.
Legal advisers.
IT support providers.
Other professional service providers.
Business transfers
If I sell, transfer or reorganise all or part of my business, relevant information may be disclosed to professional advisers and a prospective buyer or successor.
Any recipient would be required to handle the information appropriately and use it only for purposes connected with the proposed transaction and continued operation of the business.
Authorities and legal recipients
I may disclose information where required by law or where reasonably necessary to:
Comply with a court order or legal obligation.
Respond to a regulator or public authority.
Prevent fraud or protect someone’s safety.
Establish, exercise or defend a legal claim.
Protect my rights, property or business.
I do not sell personal information.
10. International transfers
Some website, cloud, gallery, file-transfer, analytics, payment, marketing and advertising providers operate internationally or use systems located outside the United Kingdom.
This means personal information may be processed in countries with different data-protection laws.
Where personal information is transferred outside the UK, I take reasonable steps to ensure that an appropriate safeguard is available.
Depending on the destination and provider, this may include:
UK adequacy regulations.
The UK International Data Transfer Agreement.
The UK Addendum to approved contractual clauses.
Contractual, technical and organisational protections provided by the relevant service provider.
You may contact me for further information about the safeguards relevant to a particular transfer.
11. How long I keep personal information
I do not keep personal information for longer than reasonably necessary.
The relevant period depends on why the information was collected and whether it must be retained for legal, tax, contractual, licensing, insurance or legitimate business purposes.
My normal retention approach is set out below.
Enquiries that do not become bookings
Enquiry information will normally be retained for up to 24 months after the last meaningful contact.
It may be retained for longer where there is a reasonable prospect of future work, an ongoing professional relationship or a possible legal dispute.
Client, customer, order and accounting records
Contracts, invoices, orders, payment records and related business correspondence will normally be retained for approximately six years.
Information may be retained for longer where required in connection with:
A dispute or legal claim.
Copyright ownership.
A continuing usage licence.
Insurance.
An ongoing contractual obligation.
Another legal requirement.
Photography, video and audio files
Project files may be retained after delivery for:
Backup and recovery.
Reorders or replacement files.
Continuing licences.
Portfolio use.
Copyright records.
Future edits.
Archive purposes.
Establishing or defending legal claims.
The retention period will depend on:
The nature of the project.
The client agreement.
Any usage licence.
Whether the content continues to be used.
The likelihood of a future reorder or archive request.
The sensitivity of the content.
Whether continued storage remains reasonably necessary.
Unsuccessful takes, duplicate files, temporary working files and files that are no longer required may be deleted sooner.
Selected final photographs, video or audio may be retained for longer-term archive, copyright, portfolio or licensing purposes where this remains lawful and proportionate.
Where a client agreement specifies a particular archive or deletion period, that agreement will normally determine how long the relevant files are retained.
Permissions and model releases
Model releases, permissions, consent records, usage restrictions and copyright information may be retained for as long as the associated content continues to be held or used.
This allows me to demonstrate how the content may lawfully be used and to respect any restrictions.
Marketing and waiting-list information
Marketing information will normally be retained until you:
Unsubscribe.
Withdraw your consent.
Object to the marketing.
Remain inactive for a period that makes continued retention unnecessary.
Inactive waiting-list and marketing records will normally be reviewed after 24 months.
A minimal suppression record may be retained for longer so that an unsubscribe or objection continues to be respected.
Website analytics and advertising information
Cookie, analytics and advertising information is retained according to:
Your consent choices.
My settings with the relevant provider.
The provider’s applicable retention periods.
Whether continued retention remains necessary.
Anonymous or aggregated statistical reports may be retained for longer because they do not directly identify individual visitors.
Complaints and data-protection requests
Records relating to complaints, access requests and other data-protection matters may normally be retained for up to six years after the matter is closed where this is necessary to demonstrate how the request was handled.
Information that is no longer required will be deleted, anonymised or securely destroyed.
12. How I protect personal information
I use reasonable technical and organisational measures to protect personal information against loss, unauthorised access, misuse, alteration or disclosure.
These measures may include:
Secure website connections and SSL encryption.
Password-protected accounts and devices.
Access controls.
Multi-factor authentication where available.
Reputable website, payment, email, gallery, storage and cloud-service providers.
Software and device updates.
Appropriate backups.
Limiting access to people who genuinely require the information.
Contractual confidentiality and data-protection requirements where appropriate.
No internet service, transmission method or storage system can be guaranteed to be completely secure.
You should therefore take care when sending information electronically and avoid including unnecessary sensitive information in contact forms or emails.
13. Your data-protection rights
Depending on the circumstances, you may have the right to:
Ask whether I hold personal information about you.
Request a copy of your personal information.
Ask me to correct inaccurate or incomplete information.
Ask me to delete information in certain circumstances.
Ask me to restrict how information is used.
Object to processing based on legitimate interests.
Object to direct marketing at any time.
Receive certain information in a portable format.
Withdraw consent where processing is based on consent.
Raise a complaint about how your information has been handled.
These rights are subject to legal conditions and exceptions.
For example, I may need to retain certain information to:
Comply with tax or accounting law.
Complete a contract.
Maintain copyright or licensing records.
Protect freedom of expression.
Establish, exercise or defend a legal claim.
A request to delete a photograph or recording does not automatically require deletion in every circumstance. I will consider the purpose for which it is held, the lawful basis being relied upon, any applicable exemptions and the rights of everyone involved.
To exercise a right, email ross@rossjukesphoto.co.uk and explain what you are requesting.
I may ask for reasonable information to verify your identity and locate the relevant records.
I will normally respond within one month. Additional time may be permitted where a request is particularly complex or where several requests have been made.
There is normally no fee for exercising your rights. A reasonable fee may be charged, or a request may be refused, where it is manifestly unfounded or excessive.

I would appreciate the opportunity to investigate your concern first, but you are not required to contact me before approaching the Information Commissioner’s Office.
15. Automated decision-making and profiling
I do not use personal information to make solely automated decisions that have legal or similarly significant effects on you.
Analytics and advertising providers may use automated systems to:
Group website visitors.
Measure activity.
Create advertising audiences.
Estimate interests.
Personalise advertising.
Where this involves non-essential cookies, advertising identifiers or similar technologies, it is subject to the cookie controls and consent choices available on the website.
16. Children’s information

Where children are involved, I will consider the circumstances of the project, safeguarding requirements, client instructions and any relevant permissions or restrictions.

17. Third-party websites and services
The website may link to:
External websites.
Online shops.
Social-media services.
Video platforms.
Affiliate partners.
Product manufacturers.
Other third-party services.
Selecting an external link may allow that organisation to collect information about you.

18. Changes to this Privacy Policy
I may update this Privacy Policy when:
My services or website change.
I introduce a new provider or technology.
Data-protection law or regulatory guidance changes.
I identify a need to clarify how information is handled.
The latest version will be published on this page and the date at the top will be updated.
